Will the Minister of WOMEN AND CHILD DEVELOPMENT be pleased to state:
- (a) whether the Government has taken any steps to identify orphans in the country, if so, the details and the outcome thereof;
- (b) the total number of orphanages functioning in the country along with children living therein during the last three years, State/UT-wise particularly in Jharkhand;
- (c) whether the Government proposes any new schemes for education and development of children living in these orphanages and if so, the details thereof;
- (d) the amount of funds allocated/ released and utilised to run such orphanages during the last three years;
- (e) whether any suggestions have been received from the Government of Jharkhand regarding functioning of orphanages and the welfare of orphans living in them; and

(a) As per Section 2(42) of the Juvenile Justice (Care and Protection of Children) Act, 2015 “orphan” means a child who is without biological or adoptive parents or legal guardian; or whose legal guardian is not willing to take, or capable of taking care of the child. Section 2(14) (vi) of the JJ Act, 2015 defines children in need of care and protection (CNCP) as ones who does not have parents and no one is willing to take care of, or whose parents have abandoned or surrendered him. Therefore CNCP includes orphan children inter-alia. The Act mandates Institutional and Non-Institutional care for such children. The government has been implementing Child Protection Services-a scheme to deliver the security net as envisaged under JJ Act, 2015. However, the primary responsibility of execution of the Act lies with the State Governments/UT Administrations.
(b): Total no. of Child Care Institutions (CCIs) funded by government during last three years is as per
Annexure-I.
(c): The provisions of care and protection of vulnerable children living in CCIs are defined under JJ Act, 2015 and JJ Model Rules, 2016. The children are also mandated to get education under Sarva Shiksha Abhiyaan of the Union Government.
(d): The Ministry does not release any funds directly to any CCIs. Funds are released to State Governments/UT Administrations for managing institutions as recommended by them. State-wise releases made under CPS during the last three years are at Annexure-II.
(e): No specific suggestions from the Government of Jharkhand have come in the notice of the Ministry. (f): The question does not arise in view of (e) above.
