Central Motor  Vehicles (First Amendment) Rules, 2021 : Gazette Notification

NOTIFICATION
New Delhi, the 7th January, 2021
G.S.R. 15(E).— Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 624 (E), dated the 07th October, 2020 in the Gazette of India, Extraordinary, Part-II, section 3, sub-section (i), inviting objections or suggestions from any person likely to be affected thereby within the period of thirty days from the date of publication in the Official Gazette;

Whereas, copies of the said Gazette notification were made available to the public on the 07th October, 2020;

And whereas, the objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government.

Now, therefore, in exercise of the powers conferred by section 9 and section 27 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —

1. (1) Short title and commencement. – These  rules may be  called the Central Motor  Vehicles (First Amendment) Rules, 2021.

(2) Save as otherwise provided in these rules, they shall come into force with effect from 15th February 2021.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as said rules), in rule 14, for sub-rule (2), the following shall be substituted, namely: –

“(2) An   application   for   an   International   Driving   permit   shall   be   made   online   through   the portal www.parivahan.gov.in in Form 4A and shall be accompanied by —

(a) valid driving licence issued by the licensing authority under these rules;

(b) appropriate fee as specified in rule 32;

(c) three copies of the applicant’s recent passport photograph;

(d) valid proof of Indian Nationals;

(e) valid proof of passport; ”.

3. In the said rules, in rule 32, for in the table, for sl. No. 5 and entries relating thereto, the following shall be inserted, namely: –

“5. In respect of issue of International Driving Permit One thousand rupees

Additional fee of Rupees Two thousand shall be levied

14(2)(b) 9”
in case the applicant has applied online through Indian
Mission/ Post abroad from a foreign nation having expired
IDP.
4. In the said rules, in Form 4A, in the Table under Particulars to be furnished by Applicant,
(a) in serial number 4 and entries relating thereto, the following shall be inserted:-
“(c) Mobile …………………………….
(d) Email Id ……………………………..”
(b) for serial number 11 and entries relating thereto, the following shall be inserted:-
(a) Have you been disqualified for obtaining a driving license
to drive? If so, for what reason?
(b) Have you been barred by the current country to drive in
that country? If so, for what reason?
(c) for serial number 15, the following shall be substituted: –
“15. Present address where I wish to collect my IDP, (applicable only in case if applicant is applying from a Foreign Country after expiry of IDP issued during his current stay)……………………………………………………………”.

Note:  The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide notification number G.S.R. 590(E), dated the 2nd June, 1989 and lastly amended vide notification number G.S.R 690(E), dated 06.11.2020.
