IMPLEMENTATION OF MOTOR VEHICLES (AMENDMENT) ACT, 2019

Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:
(a) the names of State which have implemented the Motor Vehicles (Amendment) Act, 2019;
(b) the increase in amount of fine in the new Act, 2019, percentage-wise and fines under which this increase has been made;
(c) whether the drivers are being provided with quality roads and orderly traffic arrangements;
(d) the improvement in compliance with the rules after the introduction of the new hefty fines, percentage-wise; and
(e) whether Government will consider refunding the increased fine, if there has been no improvement, in view of the economic crisis due to the pandemic?

STATEMENT REFERRED TO IN REPLY TO PARTS (a) to (e) OF THE RAJYA SABHA STARRED QUESTION NO. 220 ANSWERED ON 09.08.2021 ASKED BY SMT. CHHAYA VERMA REGARDING IMPLEMENTATION OF MOTOR VEHICLES (AMENDMENT) ACT, 2019
(a) The Ministry has not received any information from any State that has not implemented the provisions of the Motor Vehicles (Amendment) Act, 2019.
(b) Comparison of fines between the Motor Vehicles Act, 1988 and The Motor Vehicles (A) Act, 2019 may be seen at Annexure.
(c) The Motor Vehicles (Amendment) Act, 2019, recently passed by the Parliament, has inserted a new Section 198A in the Motor Vehicles Act, 1988, which provides as under:-
198A Failure to comply with standards for road design, construction and maintenance-
(1) Any designated authority, contractor, consultant or concessionaire responsible for the design or construction or maintenance of the safety standards of the road shall follow such design, construction and maintenance standards, as may be prescribed by the Central Government from time to time.
(2) Where failure on the part of the designated authority, contractor, consultant or concessionaire responsible under sub-section (1) to comply with standards for road design, construction and maintenance, results in death or disability, such authority or contractor or concessionaire shall be punishable with a fine which may extend to one lakh rupees and the same shall be paid to the Fund constituted under section 164B.” Further, the implementation of the Motor Vehicles Act, 1988 and Central Motor Vehicles Rules, 1989 comes under the purview of State Governments and Union Territories.
(d) The number of challans has increased after the implementation of the Motor Vehicles (Amendment) Act, 2019. During the period of 23 months before the implementation of The Motor Vehicles (Amendment) Act, 2019, the number of traffic challans were 1,96,58,897 and after the implementation , the traffic challans are 7,67,81,726 during the same period of 23 months. Thus, there is an increase of 291% in the traffic challans. This is due to (i) installation of Camera/ speed gun- based automatic violation detection system to ensure the compliance of rules, which was almost negligible before implementation of the Motor Vehicles (Amendment) Act, 2019 and (ii) better enforcement.
(e) No such proposal is under consideration with this Ministry.
