NOTIFICATION

Delhi, the 9th September, 2021

No. F. 11(58)/ADMN./LJ &LA/19/7611-7616.—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with Government of India, Ministry of Home Affair’s Notification GSR 840 dated 13th July, 1959, and in supersession of the Notification No. F. 2(3)/77.SII dated the 14th August, 1986, the Lieutenant Governor of the National Capital Territory of Delhi, in consultation with the Union Public Service Commission’s vide reference no. 3784 dated 26th August, 2021 hereby makes the following rules to regulate the method of recruitment to the post of Deputy Secretary in the Law, Justice and Legislative Affairs Department, Government of National Capital Territory of Delhi as following, namely:

1. Short title and commencement — (1) These rules may be called the Deputy Secretary in the Law, Justice and Legislative Affairs Department, Government of National Capital Territory of Delhi Recruitment Rules 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, its classification and pay level in the pay matrix. – The number of said post, its classification and pay scale of pay attached thereto shall be as specified in Columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc: – The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in the Columns (5) to (13) of the said Schedule.

4. Disqualification:- No person,

(a) who has entered or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted marriage with any person; shall be eligible for appointment to any of the said posts:

Provided that Government of National Capital Territory of Delhi, may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds of doing so, exempt any person from the operation of this regulation.

5. Power to relax: – Where the Government is of opinion that if necessary or expedient so to do, it may, by order, for reasons to recorded in writing be, and in consultation with Union Public Service Commission, may relax any of the provision of these rules with respect to any class or category of persons.

6. Saving:- Nothing in these rules shall effect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Schedule Tribes, Ex-servicemen. Other Backward Classes and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

Promotion:

Assistant Legal Adviser, Law, Justice and Legislative
Affairs Department with 7 years of regular service in the
grade and having completed two to four weeks of training in
the relevant field as prescribed by the Administrative
Department.

Note : Where juniors who have completed their
qualifying/eligibility service are being considered for
promotion, their seniors would also be considered provided
they are not short of the requisite qualifying/eligibility
service by more than half of such qualifying/eligibility
service, or two years, whichever is less,

and have successfully completed their probation period for
promotion to the next higher grade along-with their juniors
who have already completed such qualifying/eligibility
service.

Deputation:

Officers of the Central Govt./ State Govt./ Union
Territories : (a)(i) holding analogous posts on regular
basis; or

(ii) with 5 years of service rendered after appointment
thereto on regular basis post in Level 10 (Rs.
56100-177500/-) in the parent cadre or department.

And

(b) possessing the following qualification and experience:-

(i) Degree in Law from a recognized University or
equivalent.

(ii) 5 years experience of legislative and or advice work
in Law Department or 5 years experience as an Advocate.

NOTE : The Departmental Officers in the feeder category who
are in direct line of promotion will not be eligible for
consideration for appointment on deputation. Similarly,
Deputationists shall not be eligible for consideration for
appointment by Promotion.

The period of deputation including the period of deputation
in another ex-cadre post held immediately preceding this
appointment in the same or some other
organization/department of the Central Government shall
ordinarily not exceed four years. The Maximum age limit for
appointment by deputation shall not exceed 56 years as on
the last date of receipt of applications.
