NOTIFICATION

New Delhi, the 14th August, 2024

G.S.R. 500(E).—In exercise of the powers conferred by sub-section (1) and (3) of section 12 of the Railway Claims Tribunal Act, 1987 (Act No. 54 of 1987) and in supersession of the Railway Claims Tribunal (Group ‘A’ and ‘B’ posts) Recruitment Rules, 1997, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Registrar, Additional Registrar and Assistant Registrar in the Railway Claims Tribunal, namely : —

1. Short title and commencement :- (1) These rules may be called the Railway Claims Tribunal (Group ‘A’ and ‘B’ posts) Recruitment Rules, 2024.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Application :- These rules shall apply to the posts mentioned in column 1 of the Schedule, annexed to these rules.

3. Number of posts, classification and scale of pay :- The number of the said posts, their classification and the level in the pay matrix attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

4. Methods of recruitment, age-limit, qualifications etc. :– The method of recruitment to the said posts, age-limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said schedule.

5. Absorption or regularisation of existing employees :- (1) Notwithstanding anything contained in the provisions of these rules, the persons holding the posts of Registrar, Additional Registrar and Assistant Registrar on the date of commencement of the rules either on transfer or on deputation basis and who fulfill the qualifications and experience laid down in these rules and who are considered suitable by the Departmental Promotion Committee shall be eligible for absorption/regularization in the respective grades subject to the condition that such persons exercise their option for the absorption and that their parent Departments do not have any objection to their being absorbed in the Tribunal.

(2) The seniority of officers mentioned in sub-rule (1) shall be determined with reference to the dates of their regular appointment to the said posts.

Provided that, the seniority of officers recruited from the same source and in the posts held by them in the parent Department shall not be disturbed.

(3) Suitability of persons for absorption may be considered by a Departmental Promotion Committee.

6. Disqualification :- No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having spouse living, has entered into or contracted a marriage with any other person shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

7. Power to relax :– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

8. Saving :– Nothing in these rules shall affect reservations, relaxations of age-limit and other concessions required to be provided for the Schedule Castes, the Schedule Tribes, other backward classes, ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(ii) With 3 years service in the Grade rendered after appointment thereto on a regular basis in the level-13 (Rs.1,23,100/- —Rs.2,15,900/-) in the Pay Matrix or equivalent in the parent cadre or Department; and

(b) (i) having a degree in Law from a recognised University or equivalent and

(ii) Ten years experience in court             procedures, Commercial or Railway Claims      matters including administrative experience at Group ‘A’ level, (Period         of deputation including period of deputation   in   another   ex- Cadre post held immediately  preceding  this appointment in the  same  or some other Organisation or Department  of the Central Government shall ordinarily  not exceed three years.

(iii) The maximum age-limit for  appointment by transfer on   deputation   or   transfer shall be no exceeding fifty- six years as on  the closing date of receipt of applications).

(a) (i) holding analogous posts on a regular basis; or

(ii) With five years, regular service in posts in the level-11 (Rs.67,700/- — Rs.2,08,700/-) in the pay matrix or equivalent; and

(b) Possessing the following educational qualifications and experience:

(i)   Degree in law from a recognised University or equivalent; and

(ii)     ten years experience in administration or Accounts or personnel matters including three years experience of dealing with Commercial or  Railway Claims matters or  handling judicial or quasi-judicial functions.

Note: Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not exceed three years.

(iii)     the maximum age-limit for appointment by transfer on deputation or transfer shall be not exceeding fifty-six years as on the closing date of the receipt of applications.

(iii)    with three years’ service in the grade rendered after appointment thereto on a regular basis in the level-7 (Rs.44,900/- — Rs.1,42,400/-) in the pay matrix or equivalent in the parent cadre or Department; or

(iv)   with seven years’ service in the grade rendered after appointment thereto on a regular basis in the level-6 (Rs.35,400/- — Rs.1,12,400/-) in the pay matrix or equivalent in the parent cadre or Department; and

(b) possessing the following qualifications and experience,—(i) Graduation from a recognized University or equivalent:

(ii)   three years’ experience in administrative or accounts work or court procedures. (Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not exceed three years.

(iii) the maximum age-limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of the receipt of applications).
