RERA Approves DDA’s Dwarka HIG Project Amid Sales Query

On April 3, 2024, RERA approved Delhi Development Authority’s HIG housing project in Dwarka Sector 19B, post queries on pre-registration sales. The Real Estate Regulatory Authority (RERA), on April 3, 2024, granted registration to the Delhi Development Authority’s project for construction of HIG (multi-storeyed) houses in Dwarka Sector 19B, according to a TOI report.

The move comes a day after RERA demanded an explanation from DDA regarding putting the flats on sale without obtaining a registration certificate.

Since the applicant promoter has advertised and sold flats before obtaining project registration and the act was in contravention to section 3 of Real Estate (Regulation and Development) Act, 2016, the applicant promoter is directed to give explanation by April 2023 as to why penalty should not be levied on them under Section 59 of the act, the RERA order stated as cited in the media report. The case is listed for hearing on April 30.

RERA noticed that the applicant had issued public advertisements to sell the flat in violation of section 3 of the act.

A RERA official said that though DDA had applied for registration for the first time on June 1, 2023 but despite repeated reminders to complete the deficiencies and submitting the application in the prescribed format with all details there was no submission from the other side, as mentioned in the report.

As per the RERA Chairman, the DDA had submitted a single-page application without relevant documents or even filling the registration fee in June 2023. The registration fee was then submitted in September, mentioned an Indian Express report.

On March 15, 2023, RERA again notified the DDA to submit relevant documents to register the Golf View project. According to RERA officials, the real estate body received documents the same day, and the registration was completed on April 2, 2024. However, the registry was accompanied by an order from RERA to the DDA to explain why it should not be penalised, along with a directive to open an escrow account where the allottees’ money could be safely kept.

DDA officials said that they have received RERA approval for the flats. As regards the query on delays, the same is being responded to appropriately, as per reports.
