ISSUANCE OF DRIVING LICENSE

Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:
(a) whether the Government is aware that issuance of driving license through collusion of middlemen and transport authorities is one of the major reasons for frequent accidents and rising death toll in the country and if so, the details thereof;
(b) whether the Supreme Court of India has directed the Union Government to review legal age of holding a driving license to drive a transport vehicle of a particular weight;
(c) if so, the details thereof and the response of the Government in this regard;
(d) whether the Government has held any consultation with multiple stakeholders in this regard and if so, the details thereof and the response of the stakeholder thereto;
(e) whether the Government has held any consultation with States and Union Territories in this regard and if so, the details thereof and the timeline fixed for the same; and
(f) the manner in which it would help in improving the road safety in the country?
ANSWER

(a) In terms of Section 211A of the Motor Vehicles Act, 1988,Ministry vide G.S.R. 240(E) on 31st March 2021 has amended Rule 10 of the Central Motor Vehicles Rules, 1989 and made provisions for use of portal for submission of application for learner’s licence. Further, vide above notification Rule 11 of the Central Motor Vehicles Rules, 1989 has also been amended, thereby mandating the applicant to complete a tutorial on safe driving on the portal as a pre-requisite to appear in online test for issuance of learner’s licence electronically. The grant of driving licence is subject to driving test prescribed in Rule 15 of Central Motor Vehicles Rules, 1989. Ministry vide S.O. 4353(E) dated 16th September, 2022, has also introduced various transport related services through Aadhaar authentication on voluntary basis for the purpose of usage of digital platforms to ensure transparency, good governance and for promoting ease of living of residents and enabling better access of services to the citizens. Implementation of provisions contained in the Motor Vehicles Act, 1988 and rules made there under comes under the purview of concerned State/UT Governments.
(b) No sir. The directions of the Supreme Court do not cover the review of the legal age of holding a driving license to drive a transport vehicle of a particular weight.
(c) to (f) Does not arise.
