Transfer Policy in Kendriya Vidyalaya Sangathan

Will the Minister of EDUCATION be pleased to state:

(a) whether teachers were transferred in Kendriya Vidyalaya Sangathan (KVS) in the month of September, 2022 by keeping the extant transfer guidelines in abeyance, if so, the details of teachers who have joined the new place of posting;

(b) whether most of the teachers who were transferred approached the Central Administrative Tribunal (CAT) against these transfers, if so, details thereof;

(c) if so, the details of teachers, who were relieved from their respective schools, were allowed to join again in the same school in compliance of CAT orders;

(d) whether salary of the intervening period from date of relieving from school and rejoining in same school have not been paid so far for some teachers and they are being asked to apply leave for this period;

(e) if so, the reasons therefor and the details of action being initiated against the concerned persons;

(f) whether KVS has any transfer policy or guidelines for transfer of teaching and non-teaching staff and if so, when was this policy/guidelines formed and the details of procedure followed in its formation;

(g) the reasons for KVS to keep its transfer policy in abeyance just after one year of its formation; and

(h) other steps being taken by the Government for formulation and implementation of stable transfer policy keeping interest of all stakeholders?

(a) to (h) Kendriya Vidyalaya Sangathan (KVS) has informed that in the month of September, 2022, 1455 teachers were transferred on administrative ground for rationalization and redistribution of teachers for ensuring availability of adequate number of regular teachers in the schools. 489 teachers have joined the new place of posting.

 

Remaining teachers have approached the Central Administrative Tribunal (CAT) for stay to allow them to continue in the same Kendriya Vidyalaya (KV) from which they have been transferred. In compliance of the Hon’ble CAT stay orders, about 800 teachers have re-joined in their respective schools and time frame has been indicated for disposal of representation. Salary to the concerned teachers for the intervening period is payable as per rules.

KVS has its own Transfer Guidelines for teaching staff upto Post Graduate Teachers and non-teaching staff upto Assistant Section Officers. All employees are liable to be transferred anywhere in India at any point of time and transfer to a desired location cannot be claimed as a matter of right. While effecting transfers, the organizational and students interests have been given uppermost consideration. The guidelines were modified in 2021 and transfers were carried out accordingly.

Due to COVID pandemic, there has been significant learning loss and normal schooling has been disrupted. Hence, to address the learning gaps, administrative transfers were undertaken in 2022 for rationalization and redistribution of teachers for ensuring availability of adequate number of regular teachers in the schools.

KVS transfer policy is formulated keeping the interest of all stakeholders, primarily the interest of the students to ensure quality education.
