RESERVATION IN PROMOTION TO SCs/STs

Will the PRIME MINISTER be pleased to state:

(a) whether the Government has taken steps to implement the Supreme Courts verdict on Reservation in Promotion to SCs and STs and if so, the details thereof;

(b) whether the Government has taken any initiative to find out the backlog vacancies meant for SCs and STs in Union Government Departments and if so, the details thereof;

(c) whether the Government intends to implement ‘Reservation in Private Sector’; and

Reservation in Promotion to SCs and STs

(d) if so, the details thereof including the position of Government in this regard?

(a): In pursuance of Hon’ble Supreme Court judgment dated 28.1.2022 in the matter of Jarnail Singh and Ors. VL achhmi Narain Gupta and Ors., Department of Personnel and Training has issued an Office Memorandum No.36012/16/2019-Estt(Res) dated 12.04.2022, advising all the Ministries/Departments of the Central Government to comply with certain conditions before implementing the policy of reservation in promotion which, inter alia, include collection of quantifiable data regarding inadeq uacy of representation of Scheduled Castes (SCs) and Scheduled Tribes (STs) and application of this data to each cadre separately.

(b): DoPT collects data regarding backlog reserved vacancies of SCs and STs from 10 Ministries/Departments, having more than 90% of the employees in Central Government and monitors the progress with regard to filling up of these backlog reserved vacancies. The data on backlog reserved vacancies in the above  10 Ministries and Departments as on 1.1.2021 is at Annexure.

(c) & (d): Achieving progress on the issue of affirmative action, is through voluntary action by the industry itself. Industry representatives are also of the view that reservation is not a solution but they are willing to partner with the Government and appropriate agencies in enhancing and expanding the current recruitment policy for the marginalized . section, especially the SC and ST at all levels, as also to encourage skill development and training.

Accordingly, the Apex Industry Associations have prepared Voluntary Code of Conduct (VCC) for their member companies centered around education, employability, entrepreneurship and employment to achieve inclusion. Measures undertaken by the member of industry Associations, inter-alia, includes scholarships, vocation training, entrepreneurship development programmes and coaching etc.

क्या प्रधान मंत्री यह बताने की कृपा करेंगे कि:
(क) क्‍या सरकार ने अनुसूचित जाति तथा अनुसूचित जनजाति की पदोन्नति में आरक्षण पर उच्चतम न्यायालय के फैसले को लागू करने के लिए कदम उठाए हैं और यदि हां, तो तत्संबंधी ब्यौरा क्या है;
(ख) क्या सरकार ने केन्द्र सरकार के विभागों में अनुसूचित जाति तथा अनुसूचित जनजाति के लिए बकाया रिक्तियों का पता लगाने के लिए कोई पहल की है और यदि हां, तो तत्संबंधी ब्यौरा क्या है;

(ग) क्या सरकार का इरादा “निजी क्षेत्र में आरक्षण” को लागू करने का है; और

(घ) यदि हां, तो तत्संबंधी ब्यौरा क्या है और इस संबंध में सरकार की क्या स्थिति है?

(क): जरनैल सिंह एवं अन्य बनाम लक्ष्मी नारायण गुप्ता एवं अन्य के मामले में माननीय उच्चतम नन्‍्यायात्रय के दिनांक 28.01.2022 के निर्णय के अनुसरण में कार्मिक और प्रशिक्षण विभाग ने दिनांक 12.04.2022 को कार्यात्रय ज्ञापन संख्या 36012/16/2019 -स्था. (आरक्षण) जारी किया है, जिसमें केन्द्र सरकार के सभी मंत्रालयों/विभागों को पदोन्‍नति में आरक्षण की नीति लागू करने से पूर्व कुछ शर्तों के पालन करने की सलाह दी गई है, जिसमें अन्य बातों के साथ-साथ अनुसूचित जाति (अजा) एवं अनुसूचित जनजाति (अजजा) के प्रतिनिधित्व की अपर्याप्तता से संबंधित परिमाणात्मक आंकड़ों को एकत्रित करने तथा इन आंकड़ों को प्रत्येक संवर्ग में पृथक रूप से लागू करना शामिल है।
(ख): कार्मिक और प्रशिक्षण विभाग केन्द्र सरकार में 90% से अधिक कर्मचारियों वाले 10 मंत्रालयों/विभागों में अनुसूचित जातियों एवं अनुसूचित जनजातियों की बैकलॉग आरक्षित रिक्तियों के संबंध में आंकड़े एकत्र करता है तथा इन बैकलॉग आरक्षित रिक्तियों को भरने के संबंध में की गई प्रगति की निगरानी करता है। दिनांक 01.01.2021 की स्थिति के अनुसार उपर्युक्त 10 मंत्रालयों और विभागों में बैकलॉग आरक्षित रिक्तियों से संबंधित आंकड़े संलग्नक में दिए गए हैं।
(ग) और (घ): सकारात्मक कार्रवाई के मुददे पर प्रगति उद्योग द्वारा स्वयं की गई स्वैच्छिक कार्रवाई के माध्यम से प्राप्त की जा सकती है। उदयोग के प्रतिनिधियों का भी यही मानना है कि आरक्षण कोई हल नहीं है परंतु वे सभी स्तरों पर कमजोर वर्ग विशेष रूप से अनुसूचित जाति एवं अनुसूचित जनजाति के लिए वर्तमान भर्ती नीति को बढ़ाने और उसका विस्तार करने और साथ ही कौशल विकास और प्रशिक्षण को बढ़ावा देने के लिए सरकार एवं समुचित एजेंसियों के साथ भागीदार बनने के लिए तैयार हैं। तदनुसार, शीर्ष उद्योग संघ ने अपनी सदस्य कंपनियों के लिए वॉलंटरी कोड ऑफ कंडेक्ट (वीसीसी) तैयार किया है जिसमें समावेशिता को प्राप्त करने के लिए इसे शिक्षा, नियोजनीयता, उदयमिता और रोजगार केन्द्रित बनाया गया है। उद्योग संघ के सदस्य द्वारा किए गए उपायों में अन्य बातों के साथ-साथ छात्रवृत्तियां, व्यावसायिक प्रशिक्षण, उद्यमिता विकास कार्यक्रम और कोचिंग आदि शामिलत्र है।
