Joint Secretary and Legislative Counsel
G.S.R. 586(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing (Group ‘A’ Posts Hindi Branch) Recruitment Rules, 2013, in so far it relates to the post of Joint Secretary and Legislative Counsel, except as respects things done or omitted to be done before such supsession, the President hereby makes the following rules regulating the method of recruitment to the post of Joint Secretary and Legislative Counsel in the Official Languages Wing, Legislative Department, Ministry of Law and Justice, namely:-

1. Short title and commencement.– (1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, Joint Secretary and Legislative Counsel (Group ‘A’ Post), Recruitment Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix.– The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.–  No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.– Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

Promotion:—

Additional Legislative Counsel (Hindi Branch) in the
Official Languages Wing in level 13 (Rs.1,23,100- 2,15,900
) in the pay matrix with three years regular service in the
grade.

Deputation:
—-

Officers under the Central Government or State Government
or Union territories; –

(a)(i) holding analogous posts on regular basis in the
parent cadre or Department; or

(ii) with two years service in the grade rendered after
appointment thereto on a regular basis in level 13A in the
pay matrix Rs.131100-216600 or equivalent in the parent
cadre or Department; or

(iii) with three years service in the grade rendered after
appointment thereto on a regular basis in level 13 in the
pay matrix Rs.123100-215900 or equivalent in the parent
cadre or Department; and

(b) possessing the following educational qualifications and

Group ‘A’ Departmental Promotion Committee for promotion
consisting of:-

1. Chairman or Member, Union Public Service Commission

—Chairman;

2. Secretary, Legislative Department, Ministry of Law and
Justice —Member;

3. Additional Secretary, Legislative Department, Ministry
of Law and Justice —Member;

4. Additional Secretary, Legislative Department, Ministry
of Law and Justice —Member.

Consultation with Union

Public Service Commission is necessary while filling up the
post on deputation basis.

experience:- Essential :-

(A) (i) Masters Degree in Law (LLM) from a recognised
University or Institution; and

(ii) Possessing the following:

(I) a member of State Judicial Service for a period of
thirteen years; or

(ii) a Central or State or Union Territory Government
Servant or an executive or officer in a Public Sector or
Undertaking or Statutory Body or Autonomous Body who has
had experience in legal affairs for thirteen years; or

(III) a qualified legal practitioner who has practised as
such for thirteen years; or

(IV) a teacher of Law for thirteen years in a recognized
institution; or

(V) thirteen years experience of translation into Hindi of
statutes, statutory rules and orders in Central Government
or State Government or Union Territory; or

(VI) thirteen years experience of drafting of statutes in
the Central Government or State Government or Union
Territory; and

(iii) passed Secondary School Examination or any higher
examination from a recognised Board or University or
institution through Hindi medium or had offered Hindi as a
subject in Secondary School Examination or any higher
examination from a recognised Board or University or any
institution or foreign university approved by the Central
Government. Or

(B) (i) Bachelors Degree in Law (LLB) from a recognised
University / Institution; and

(ii) possessing the following:

(I) a member of State Judicial Service for a period of
fifteen years; or

(II) a Central or State or UT Government Servant / an
executive / officer in a Public Sector Undertaking /
Statutory Body / Autonomous Body who has had experience in
legal affairs for fifteen years; or

(III) a qualified legal practitioner who has practised as
such for fifteen years; or

(IV) a teacher of Law for fifteen years in a recognized
institution; or

(V) fifteen years experience of translation into Hindi of
statutes, statutory rules and orders in Central Government
or the State Government or Union territory; and

(VI) Fifteen years experience of drafting of statutes in
the Central Government or the State Government or Union
territory; and

(iii) passed Secondary School Examination or any

higher examination from a recognised Board or University or
institution through Hindi medium or had offered Hindi as a
subject in Secondary School Examination or any higher
examination from a recognized Board or University or any
institution or foreign university approved by the Central
Government.

Note 1:
The expression Qualified Legal Practitioner used in the
essential qualifications means a person who is an advocate
or a pleader and has practised as such for thirteen years
in case of holder of Masters Degree in Law (LLM) or 15
years in case of holder of Bachelors Degree in Law (LLB).

Note 2:
The term experience in legal affairs means holding of a
substantive legal post under the Government or Public
Sector Undertaking or Statutory Body or Autonomous Body for
which LLB degree is a prerequisite or essential
qualification for recruitment.

Desirable:

(i) Five years experience of legislative drafting in Hindi
in Central Government or State Government or Union
territory.

(ii) Bachelors degree from a recognised university with
Hindi as a subject or medium at degree level.

Note 1:
The period of deputation including the period of deputation
in another ex-cadre post held immediately preceding this
appointment in the same or some other
organization/department of the Central Government shall
ordinarily not exceed three years.

Note

2:
The Maximum age limit for appointment by deputation shall
be Not exceeding 56 years as on the last date of receipt of
applications.

Note 3:
Where juniors who have completed their
qualifying/eligibility service are being considered for
promotion, their senior would also be considered provided
they are not short of the requisite qualifying /
eligibility service by more than half of such qualifying
/eligibility service or 2 years, whichever is less and have
successfully completed their probation period for promotion
to the next higher grade along with their juniors who have
already completed such qualifying/eligibility service.

Note 4:
The departmental officers in the feeder category who are in
the direct line of promotion shall not be eligible for
consideration for appointment on deputation. Similarly, the
deputationists shall not be eligible for consideration for
appointment by promotion.
