Government of India (Allocation of Business) Three Hundred and Sixty Second Amendment Rules, 2021

NOTIFICATION

New Delhi, the 6th July, 2021

S.O. 2717(E).—In exercise of the powers conferred by clause (3) of article 77 of the Constitution, the President hereby makes the following rules further to amend the Government of India (Allocation of Business) Rules, 1961, namely:-

1. (1) These rules may be called the Government of India (Allocation of Business) Three Hundred and Sixty Second Amendment Rules, 2021.

(2) They shall come into force at once.

2. In the Government of India (Allocation of Business) Rules, 1961,-

(a) in THE FIRST SCHEDULE, –

(i) under the heading “1. Ministry of Agriculture and Farmers Welfare (Krishi Evam Kisan Kalyan Mantralaya)”, for the sub-heading “(i) Department of Agriculture, Cooperation and Farmers Welfare (Krishi, Sahkarita Evam Kisan Kalyan Vibhag)”, the following sub-heading shall be substituted, namely:-

Allocation of Business

“(i) Department of Agriculture and Farmers Welfare (Krishi Evam Kisan Kalyan Vibhag)”;

(ii) after the heading “8. Ministry of Consumer Affairs, Food and Public Distribution (Upbhokta Mamle, Khadya aur Sarvajanik Vitaran Mantralaya)” and sub-headings thereunder, for existing headings “8A. Ministry of Corporate Affairs (Corporate Karya Mantralaya)” and “8B. Ministry of Culture (Sanskriti Mantralaya)”, the following headings shall be substituted, namely; –

“8A. Ministry of Cooperation (Sahkarita Mantralaya);

8B. Ministry of Corporate Affairs (Corporate Karya Mantralaya); 8C. Ministry of Culture (Sanskriti Mantralaya)”;

(b) in THE SECOND SCHEDULE,-

(i) under the heading “MINISTRY OF AGRICULTURE AND FARMERS WELFARE (KRISHI EVAM KISAN KALYAN MANTRALAYA)”,

(A) for the sub-heading “A. DEPARTMENT OF AGRICULTURE, COOPERATION AND FARMERS WELFARE (KRISHI, SAHKARITA EVAM KISAN KALYAN VIBHAG)”, the following sub-heading shall be substituted, namely: –

“A. DEPARTMENT OF AGRICULTURE AND FARMERS WELFARE (KRISHI EVAM KISAN KALYAN VIBHAG)”;

(B) under the sub-heading “A. DEPARTMENT OF AGRICULTURE AND FARMERS WELFARE (KRISHI EVAM KISAN KALYAN VIBHAG)” as so substituted, the existing entries 24, 25, 26, 27 and 28 shall be omitted;

(ii) under the heading “MINISTRY OF CHEMICALS AND FERTILIZERS (RASAYAN AUR URVARAK MANTRALAYA)”, under the sub-heading “B. DEPARTMENT OF FERTILIZERS (URVARAK VIBHAG)”, for existing entry 2, the following entry shall be substituted, namely: –

“2. Allocation and supply linkages for movement and distribution of urea in terms of assessment made by the Department of Agriculture and Farmers Welfare”;

(iii) after the heading “MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (UPBHOKTA MAMLE, KHADYA AUR SARVAJANIK VITARAN MANTRALAYA)”, and sub- heading “B. DEPARTMENT OF FOOD AND PUBLIC DISTRIBUTION (KHADYA AUR SARVAJANIK VITRAN VIBHAG)” and entries thereunder, the following heading and entries shall be inserted, namely:-

 “MINISTRY OF COOPERATION (SAHKARITA MANTRALAYA)

1. General Policy in the field of Co-operation and Co-ordination of co-operation activities in all sectors.

Note: – The Ministries concerned are responsible for Co-operatives in the respective fields.

2. Realisation of vision “from cooperation to prosperity”.

3. Strengthening  of  cooperative  movement  in  the  country  and  deepening  its  reach  up  to  the grassroots.

4. Promotion   of   cooperative-based   economic   development   model,   including   the   spirit   of responsibility among its members to develop the country.

5. Creation of appropriate policy, legal and institutional framework to help cooperatives realise their potential.

6. Matters relating to National Co-operative Organisation.

7. National Co-operative Development Corporation.

8. Incorporation, regulation and winding up of Co-operative societies with objects not confined to one State including administration of „the Multi-State Co-operative Societies Act, 2002 (39 of 2002)‟:

Provided that the administrative Ministry or Department shall be „the Central Government‟ for the purpose of exercising powers under the Multi-State Co-operative Societies Act, 2002 (39 of 2002), for Co-operative units functioning under its control.

9. Training  of  personnel  of  co-operative  departments  and  co-operative  institutions  (including education of members, office bearers and non-officials).”.
